Regarding 12 Month Vacation and Vacation Payout

Memorandum of Understanding  

WHEREAS, Bowling Green State University (the “University”) and the Bowling Green State University Faculty Association – AAUP (“BGSU-FA”) (collectively, the “Parties”) have agreed to a Collective Bargaining Agreement (“CBA”), effective July 1, 2024 through June 30, 2027,setting the terms and conditions of employment for Bargaining Unit Faculty Members (“BUFM”);

WHEREAS, pursuant to Article 21, Section 13.1, BUFMs on an academic year (nine-month) contract are not eligible for paid vacation.

WHEREAS, pursuant to Article 21, Section 13.2.1, BUFMs on a full-time 12-month appointment accrue twenty-four (24) days of vacation per fiscal year;

WHEREAS, Article 21, Section 13.2.7 provides the following for BUFMs on a full-time 12-month appointment: after one year of service, upon separation of service, payment of accrued and unused paid vacation shall be made to the BUFM in a lump sum based on the rate of compensation at the time of separation for any accrued but unused paid vacation up to a maximum of forty-four (44) days (352 hours);

WHEREAS, if a BUFM transitions from a 12-month vacation-accruing contract to a 9-month non- vacation-accruing contract they no longer shall accrue or use vacation hours;

NOW, THEREFORE, the Parties agree as follows:

  1. If a 12-month BUFM transitions from a fiscal year contract to a 9-month academic year contract, they shall receive payment of accrued and unused paid vacation in a lump sum based on the rate of compensation at the time of transition for any accrued but unused paid vacation up to a maximum of forty-four (44) days (352 hours). Any accrued and unused vacation hours above the maximum will be forfeited.
  2. The payment of accrued and unused paid vacation shall be processed in the month after the request is made and approved by the Dean and the Provost.
  3. If the transition from a 12-month contract to a 9-month contract occurs over the summer term, upon request, the payment may be made half in July and half in August.
  4. If a 9-month BUFM returns to a 12-month vacation-accruing contract, their vacation balance will start at zero.
  5. The applicability of this Memorandum of Understanding is limited to the particular circumstances described herein.

IN WITNESS WHEREOF, the Parties have caused this Memorandum of Understanding to be made effective this _           day of October, 2024.
